With regard to the use of cookies, Article 22.2 of LSSI establishes the following:

2. Service providers may use devices for storing and retrieving data on the terminal equipment of recipients, provided that they have given their consent after having been provided with clear and complete information about their use, in particular about the purposes of data processing, in accordance with the provisions of Ley Orgánica 15/1999, de 13 de diciembre, de Protección de Datos de Carácter Personal.

The GDPR mentions cookies in Recital 30, prior to the articles of the Regulation:

(30) “Natural persons may be associated with online identifiers provided by their devices, applications, tools and protocols, such as internet protocol addresses, session identifiers in the form of ‘cookies’ or other identifiers such as radio frequency identification tags. This may leave traces which, in particular when combined with unique identifiers and other information received by the servers, may be used to create profiles of natural persons and identify them.”
